Car Broke Down , Parked On Zigzags. Can I Get A Ticket

my car was faulty ( starting and stopping , smoke billowing out exhaust )

i stopped the engine and pulled over, i was sat on a zigzag near a pedestrian crossing on a rural road. traffic warden was writing out his ticket even before he approached the car, i put window down and explained my car was faulty and i had no one to push it away from zig zag lines . he was blunt and arrogant and told me he didnt care and that i was parked on zigzag, i then said to him he has to issue me with ticket and also put it physically on my car to which he replied he doesnt.

anyway how can i beat this, a bit unfair. wasnt as if i had parked and left car for any length of time, car was there about 3-4 minutes untill i started it and moved 20 yards away.

Type or go into your local council office & explain what has happened, if the car has been repaired and a cost incurred take the receipt with you, also if you have any medical issue's, explain the reason that you could not push the car & there was no persons around to help you. I would also report tat arrogant T/Warden.

If was stopping and starting could you not have pulled up away from a zebra crossing? I also understand that stopping within the zig-zags of a zebra crossing carries an endorsement, 3 points and a £60 fine.

Appeal.

I got a ticket for parking in a loading bay. I successfully appealed it. The facts....I was taking my nan, who has dementia, to see my granddad and there was nowhere else to park within walking distance. I dropped her off and went and moved my car, which had a ticket on it.

Council waved the fine.

but i never got out of my car, does the warden have to physically issue with ticket ? does he need proof ? these are the questions i need to know. i mean he could be saying that about anyone.

i could have sat there and broke down at the zigzag ony for 2 seconds . so even if the car was stopped 2 seconds then he has a right to issue ticket ?

It is offence to park or wait on the crossing zig zags. 'Wait' means stop without getting out of the vehicle so the fact that remained in the vehicle is not a defence.

I'm not clear as to why the warden did not write out the notice and give it to you.

We don't always get physical tickets these days, though, do we? The warden takes a photo of your number plate and the location round here, the fine comes through the post.

When I've seen wardens preparing tickets the first thing they do is take a photo as evidence of the offence; then if the offender then drives off before the ticket is physically issued they still have the proof the offence occurred.

Even before camera evidence, if motorists drove off before the ticket could be issued to the driver or afixed to the windscreen the warden would make a statement to that effect and the FPN would be posted to the registered keeper.

update, yesterday around 6pm i seen another warden in city centre, i told me exactly what happened, he asked me did i get issued with yellow slip / ticket onto car , i said i did not, he told me that " you need to be issued with a ticket " full stop !!!

Dick, have you thought about why the zig zags are there in the first place? It would appear to have been your decision to stop on the zig zags when it wasn't absolutely necessary.

They have to actually issue the ticket and stick it on the car.
Boxtops never heard of getting a parking fine through the post with out a ticket issued, speeding yes but not parking. For parking they have to issue the ticket put it on the car and then photograph the car with the ticket on it to prove they actually issued the ticket .
dieseldick the warden could have been writing a note down in his/her notebook not actually writing a ticket , they have to make notes of the time and place etc before they write the actual ticket. I am sure you will hear no more about it.

Not true, Eddie, or all the drive offs would get away with it.

hand a ticket to whoever seems to be in charge of the car
send it by post under certain circumstances.

By law the PCN must be issued within 28 days of when the traffic warden saw the parking rule was broken or it was caught on camera. The guidance local authorities use says they should issue the PCN within 14 days, but they do not have to follow that guidance"

When can the PCN be sent by post?

The PCN can be sent by post if:

it was being issued as the vehicle was driven away, or
the driver or passengers were abusive, or
evidence of the parking rule being broken was caught on camera.
