Unreasonable Delivery Driver.

What would you do? My next door neighbour had a delivery from B&Q this morning. The delivery van parked over my driveway to deliver the goods which was no problem at first but after so long I needed to get my car out of my driveway to go to work.
The delivery man had finished his delivery and was just sat in his cab. I politely ask him if he would move so I could get out of my drive. He replied “Sorry mate I’m on my break” I explained to him I had to get to work. He Replied “ Tachograph won’t let me move”
I said I only want you to move A foot or so. He then said “sorry I will be breaking the law if I move- 10 minutes mate “
Then wound up the window and continued to eat his sarnies.
Do you think that by moving his lorry a few inches he would get into trouble with the law or do you think he was just being unreasonable? .
I lost a new costumer because I was late for his pick up (I’m a driving instructor) do you think I should seek compensation from B&Q.
(The lorry was across my drive for about 50 minutes)

He would not have got into trouble for moving the vehicle. I would have rung B&Q depot straight away and told driver I was doing so. If B&Q did nothing I would have rung Police. Take this as far as it will go and inform B&Q you will be going to the Press if they cannot resolve this to your satisfaction .

TWR you would not get an infringement for moving during a break, as long as you restarted the break. Your company might have a go for too much break, but this can be explained and is not a legal issue.
Actually the very latest tachos do allow you to move for up to thirty seconds during the break. As long as you reselect break it is shown as continuous break.

I would not bet on your assumption Hop! do you not know! If you are a HGV Driver in the UK, you are the worst of the worst criminal going, that's one of the main reasons I came out of the rat race after 30+years of B. ***,

I forgot to mention that I live in a cul-de-sac and it is very narrow you can only just get two cars past each other only if one stops .I live in the centre of the street so to have his break in the middle of the street he was not only blocking me in but he was also obstructing 7 other households. Any way the letter is on its way to B&Q so I will let you know what happens.
Just an update. I had a phone call from B&Q manager this morning asking me to recount what had happened on the day. I told the B&Q manager what had happened . And he said “that the delivery driver was out of order he should have moved out of the way and started his break again”. He was sorry for my inconvenience and would be sending me £50 in B&Q vouchers. I think this is quite satisfactory and I will enjoy spending them. I still think the driver was an ignorant Trucker!
