My Husband owns a house with his ex partner, he was paying the mortgage for 17 years but has now stopped, his ex partner has taken him off the mortgage and pays it herself, but the prooperty is still in joint names, does he still have legal rights on the property

If he is a joint owner he definitely has rights. For example the ex could not stop him going into the house and living there unless there is a Court order excluding him. Also, the house cannot be sold without his agreement unless a Court order is obtained.


To what extent he has a financial interest depends on the circumstances. If they were married then their respective interests should have been sorted out in the divorce. Otherwise, the two of them should try and agree a split of the value.


I think it is quite unusual for a mortgage lender to take someone off a mortgage while they remain a joint owner. Are you sure this has been done?

thanks for your answer, no i am not really sure what has happened, all i know is that we no longer pay the mortgage and we do not receive any more literature from the mortgage lender, so i assumedthat he was taken off the mortgage.
He wouldn't have been taken off the mortgage without giving up his claim to the property. He may not be actually paying towards the mortgage but he will be liable for it.
