what am i entitled to?

I have recently separated from my partner of 5 years and we have a joint mortgage on a property we bought from the local council 8 months ago. We lived there as tenants for 2 years before buying. I am now looking for a property to rent for me and my son but dont know if i am entitled to anything from the hous. he has taken over the mortgage payments but i contributed to them for 8 month and the rent before this. He says i am not entitled to anything. Any advice would be appreciated.

For more on marking an answer as the "Best Answer", please visit our FAQ.I would say you need to seek proper advice from a solicitor but i think you should be entitled to half which means selling the property and splitting the difference or your ex partner remortaging and splitting the difference, you should also be entitled to any extras you may have contibuted yourself ie. any deposit. He is obviously going to say your not entitled so that he has it easy, but so long as you know your rights you need to stick to it, its not easy but dont give up!!
You are certainly entitled to a share in they property or its equite. I do know that council ppurchases do have the aditional problem of a sale restriction within a certain period after its purchase (I think it is 5 years) i.e. if you sell the property within that period, you have to give them some or even, all of the equity from the sale (profit)
