Injury

Hello all
I chased after a youth who smashed my car window whilst it was sat on the drive.
As I was chasing him, I fell and badly injured my knee, needing medical care and 2 months off work.
I knew who the youth was and he was questioned by the police but refused to admit it was him but the court decided that he did do it and was ordered to pay the costs of the damage.
My question is, can I now make a personal claim against him for my injury bearing in mind I was only chasing him due to his actions. Is there anyway I can claim compensation against him.
This is not about the money but about the permanent injury I will now carry for the rest of my due to this morons actions

I doubt it very much. Should he have foreseen that you would fall and incur an injury? We have some barristers/legal professionals though who will be able to give a definitive answer

Is it intentional injury on the twerp's part - the difficulty is taht you chose to chase the fella. The leading case is Letang V cCooper 1965

the alternative is an action in negligence. The difficulty here is that the leading case is... letang v cooper and twerp if you think about it, wasnt really negligent

the next difficulty is causation - but for the twerp smashing your window you would not have suffered injury - but oops you fell over....
so the but-for test isnt fulfilled

things are looking bad for any civil action I think

Eddie, is your answer based on fact or opinion?
The reason I ask is, I like you would have thought that it was my decision to chase him so I would have no case.
A police officer asked me (after the case had gone to court) if he had also been charged with assault due to the fact that his actions had resulted in me giving chase to him and causing the injury. If he had not done it ,I would never have had the injury.

What PP is trying to tell you is that the youth did not cause your injury. You caused it yourself by running after him. You can not sue someone for something they did not do!

You would have to pursue it in the civil court and if this youth has no money or assets it will be an expensive waste of your time.

twerp wont have one - it will probably be in the name of his dad and therefore no good

Judge Russell agreed that damages would be entered for a bus drivers post traumatic stress disorder against the woman who stepped out in front of his bus ( who had household insurance )

Peter, the householder's house insurance would never cover such an event.
