what happens when a person goes to prison and they was paying money for three children because he and his wife are separated. Can the mother get any help regards this?
Many thanks.No it isnt to visit him. It is just he agreed to give her £130 per month for the three children but now he isin prison...would the benifits pay extra now instead.?
^^ That is of course if she told the benefits agency she was getting cash from the father of course. Most people just keep quiet about it.
Basically it means the CSA can not chase him for money as he has none.
Maintenance paid for the children (which I assume is what the £130 was) is not deducted from most benefits. She needs to ask the DWP etc. but I don't think there will be any increase in benefits if she is already getting all she is entitled to.
If the mum is unemployed and receives benefits she should have declared the money being paid by the dad and her benefits would have been adjusted accordingly. Assuming she did that she should go back to the benefits office with proof he is in prison and no longer paying for the children so her benefits can be increased as she should be entitled to more state support while the dad is unable to support the children.
