Driveway

I live in a row of 4 cottages and own the shared driveway which is about 50 metres long. My neighbour has recently asked my permission to lay a gas pipe to his property which would go under this driveway. My question is whether this would cause any legal implications if either he or I sold our houses in the future?

Not my area of expertise but if you own the entire drive I imagine you will need a "wayleave" drawn up. This will give the gas company the right to lay (and maintain) their pipework and is usually made for a small consideration in your favour.

It's quite common for neighbours' services to run within a property. The important thing is to have your solicitor draw up an "easement" which will be noted on your Land Registry records. Whether you decide to charge for this is entirely up to you.

As I've said, this is quite normal. No prospective buyer with any sense would ever baulk at this.

There are two ways the Gas Contractors would go about it........

Either ... dig a trench which would be reinstated at their (or the neighbour's) expense. Make sure this is agreed.

Or .......... usually most likely ........... they will "mole" underground without disturbing the surface.

So... talk to your Solicitor (at your neighbour's expense), and talk to the Gas Contractors and get a plan of action from them.

The utility companies are liable for pipe work up to the boundary.

If the road is not adopted it might be that they have responsibility up to the begining of the road before it becomes a private drive.

Somethng to look into perhaps.
