Query: Serving A Warning On Caveat
6 Answers
Hello everyone,
I now have the warning from the Leeds district probate registry, a copy of which I'm told to serve on the caveator.
Is there any particular procedure I should use for delivering the warning?
How will the Leeds district probate registry office know on what date the warning was served?
How will I know if an appearance has been lodged within the 8 day timeframe?
Thank you for your attention.
Robert

Post it using first class then obtain a certificate of posting. File this with Leeds together with a certificate of service. Google that.

I had to complete an "affidavit of service" which I got from the Leeds probate registry and have it sworn saying when and how the warning had been posted or delivered. As it happened I could just have used the ordinary post to deliver the warning. The Leeds registry (or wherever the caveat has been lodged) will then check whether or not the caveator has responded within the eight-day period and if not, communicate with the probate office to say that they can continue with granting the probate. It will probably be about ten days before you hear from them but you could possibly call the probate registry a few days in. You can read more about the legislation here. http:// www.leg islatio n.gov.u k/uksi/ 1987/20 24/made
