I have this theory, but Ii was thinking dont I have to patent it or copyright it or something first to ensure that someone else doesn't lay claim to it....

If you believe that you have a unique and viable idea/product, the first thing you need to do is to contact a Patent Agent (find them in Yellow Pages) and discuss the idea with them first, taking all relevant paperwork, drawings, models etc with you - DEFINITELY DO NOT discuss it with anyone else first & good luck.
As above absolutely do not discuss it with anyone. You cannot copyright an idea. However, once you have committed it to paper, it is automatically covered by copyright. You may patent an invention capable of industrial application. If you do meet up with a Patent Agent, and show them plans etc., make them sign a confidentiality agreement, it's safer for you. If you do get to patent it, you may be approached by a manufacturer (they monitor the Patent Office for interesting projects) willing to manufacture your product. Be careful you get a good deal for yourself if that happens.
