IVA / Lewis Debt Recovery
3 Answers
Hi,
I took out a personal IVA to pay off debts 3.5 years ago. One of the debts was a current acct with HSBC in mine and my wifes names.
HSBC agreed that this debt be included in my IVA payments.
I have now paid off the IVA and this debt.
A company called Lewis Debt Recovery are claiming to be working on behalf of HSBC and are harassing my wife for the debt.
I have explained a hundred times to them that I was paying it as agreed - and that it is now paid to HSBCs specification.
They seem unable to understand English and ignore my comments - sending repeated demands and threats.
Any ideas would be greatly appreciated.
Thank you

You should certainly contact your IP & ask them to get this chasing stopped. What seems likely to have happened is that HSBC have not recorded the position correctly in their records.
The other thing you could do is to contact HSBC yourself, but this should really be done by the IP.

Have just re-read your post & noticed you say it was a personal IVA. If that was the case - i.e. it was not a joint one with your wife - then it will not have wiped out her liability for this debt. This is because all such debts are joint & several - meaning that either debtor can be chased for the full amount of the debt.
If that is the case here, then the amount they are chasing should be the total amount of the debt less whatever amount HSBC received through your IVA. However, working out the correct amount can be a problem as they may have added interest (whhich will presumably have been suppressed throughout the period of your IVA).
