My partner and I split up years ago, and I didnt get round to getting him off the mortgage. He has never paid anything towards the property. He was told years ago he wasnt on the mortgage any more, by a friend, and has not asked for any money from the equity. Anyone know how to get him off the mortgage without losing all my money?
I dont think you can - any changes to a joint mortgage needs both borrowers consent. And to do a transfer of equity even after his consent - you would need to meet there lending criteria to ensure you can maintain the monthly payments. Best thing to do is to speak with your lender.
Getting him off the mortgage is not your only worry!
Is he on the deeds of the property? If so then even if you are paying the mortgage in your own right he still has a right to any equity.
So far his has cost me about �2000 in solicitors fees with neither side giving up their right!
Get a solicitor and soon but beware it could cost you a bit if he refuses, he may well ask for his share in the equity while he was living there and contributing to the mortgage.
