if i am put on a unborn babies cert, do i have any legal rights if the dna father shows up?

To start with, you cant be put on unborn baby's birth certificate as they dont get one until after they are born. Also, you shouldnt be put on it if you are not the biological father.

I am assuming you are with the baby's mother in which case, if you both want you to have rights, you can look into adopting the baby or becoming its legal guardian after it is born.

The biological parents are named on the birth certificate although you do not have to have the fathers name on it (he has to be present when baby is registered to do that anyway). I think the best thing for you to do is enquire about adopting the baby, that way you will have parental rights.
Once the baby is born, you can be put on the certificate if you and the mum are both present at the RO and you say that you are the babys father.
Why would you or the childs mother even consider putting your name down as the babies father?

The only name that should be there is the biological fathers, and not some current boyfriend that the mother has.

Sorry to sound harsh, but a child has the right to know who their natural father is and this should be reflected the BC which I believe (could be wrong on this bit) is a legal document, not something to be beggared about with as the parents are no longer together.
Isn't it an offence to supply false information on a birth certificate? Ring your local Citizen's Advice Bureau, they should be able to tell you one way or the other

To put your name as the father of a child you know isn't yours is a very nasty thing to do. The child needs to know the truth - and the truth will come to light one day and will never forgive you or the mother.

If you want to be any sort of parent start by doing right by the child - this isn't about what you want, or the mother wants, but it is what the child needs in the long term.

And it is a criminal offence to make such a false declaration on a birth certificate.
I've always believed that if you knowingly lie about the paternity of a child, then it IS an offence. I think the adoption process is what most people'd do.
you have no rights to put your name forwards...what about later on in life if the child becomes ill and needs blood or kidney egc..

and the real father is the key to that childs future ??

my god what is wrong with you people!!!!! take about knocking ten ton of crap from someone. i suggest you dont take what these hypocrits say to harshly. firstly good on you for being able to be a father to someone elses child, there arnt many men who could. secondly i think if you are going to be able to give genuine love and safelty and a happy future to this child then you ahev every right to call yourself this babies father. it takes a real man to be a father you dont have to be the sperm donor. this country is so stuffy about having a child having the right to know that their real father cared so much that they left before they were born and that he could have been a junkie or any disgusting excuse for a man. i think if i were that child and could choose whether or not to be told the truth or not. i would not want to know someone who didnt want an unborn child. i would want to only know the father who had brought me up, kissed me goodnight, taught me to ride a bike etc not some sperm donor who couldnt be bother about me to start with. be proud to call yourself this babies father. sometimes its better to not know the truth and save heartache for everyone.

Physically you can put any mans name down as the father of the child if that is your wish- the registry office don't do DNA test there and then.
In fact many women put the partner name down and later find our he is not the " real" father.
I feel many have been harsh on you in their replies.
I work with many thousansd of people each year in very similar circumstances to you. You are not being a bad parent at all! - take no notice of these replies who criticise you for asking for help!
In this day and age birth certificates are not the be all and end all they used to me.
Year ago you proved your age with them, showed them as ID etc. Now they are less and less used. This is mainly because anyone can request a copy of a birth certificate from the registry office and they don't have to be the parents or guardians of the child!- Hence also why they fall in to the wrong hands.

The main thing that you will need to consider is this. What is the reason for having this mans name on your baby's birth cert? If it is to provide security then the best thing to do in the interim is for your partner to apply for Parental Responsibility of the child. Only the birth mother and a married father has this automatically on the birth of the child. In an unmarried couple the birth mother automatically get PR and when the unmarried partner goes on the birth Cert, he gets PR too.

Again this is a farce as anyone can apply for PR over your child, I could for instance over your or anyone elses baby, however the courts would want to know why I was applying for it.

PR is not a right over the child, rather than it is a responsibility to the child. It covers matter uch as which school a child should go to, where he or she should live, how they are brought up, what religion etc.
Another important point to note is this;
If you put your partner on the birth certifcate, he will be treated as the legal father of this child, until proved otherwise by DNA etc. This means that he is also financially responsible for the child and if you split up and you go on benefits, then the state will look to seek child mantainance from him.

The family law courts (civil law) deal with these matters.

If you are raising the child with your partner (childs mum) and have a stable, committed, non volatile home the courts are very very unlikely to give the bio father custody of the child. What they will consider is why the bio father has now come back on the scene, what he wants in seeing the child, what he is like as a person, who he lives with, where he live, what his background is like, what kind of environment is he going to take the child too etc. It is likely that the best case senario would be the bio father gets acees to see the child. Also depending on the age of the child the courts will ask the child what they want.
If the bio father gets access, is will likely be limited and supervised in the first instance. This is because the child will be going with a stranger otherwise.

From a professional backgroun I would suggest that most bio fathers who leave before the baby is born, are unlikely to proceed with court proceedings to see the child and when they do, most only stick at it until the novelty wears off or the child starts asking for money, treats, clothes or when the baby becomes less of a novelty.
As the bio father will not be on the birth cert, he had NO Parental Responsibility. So he can't just turn up and take the child, that would be kidnap!. ALso if he does apply for PR the courts HAVE to seek the views and opinions of all others who already hold PR over this child.
