Hi my ex partner walked out on me and my 3 children (1 is his) about 6 weeks ago. He is now threatening to empty the house of everything he put any money towards. I had everything in the house (he is not on the tenancy) before he moved in with us but we did replace the bedroom furniture together. The main things that he wants is the tv and ps3, the ps3 came with my mobile contract and my daughter plays on it. Does anyone know where i stand legally?????

Why is it people have to disbelieve these posts? It makes for such a nice welcome to this site.

To the OP, sorry your ex is being such a brat, he must be related to mine. He tried the exact same thing, I just told him no!
As has been mentioned, is he paying child support? If no then get on to that straight away, by today's standards, if he is working and has not paid...

Possession is nine tenths of the law. If he shows up with a furniture van, call the police
Change the locks and phone the police if he tries to get in.
Change the locks. Can he prove he bought the TV, who pays for the mobile contract?
I thought that was a myth Sandy.
This is one of the occasions when a pre-nup (or a pre partner moving in) can be really useful.....
I don't know, the police come along sometimes

If he is not on the tenancy agreement then call the police if he comes round. They will bang him up for breach of the peace !
If the things are yours. he can't have them.
Take some legal advice now - citizens advice is good but as you have access to the internet , try and locate a law practice near to you that deals with family law - lots of them have a free first consultation.
If he paid for them (or some of them) then you should be prepared to let him have his fair share - but nothing more.

You might also ask him about arranging his contributions to the upbringing of his child - the letters CSA may concentrate his mind a little...

Thankyou for your quick answers, sorry Jeza but this is very true. The mobile contract is in my name and i have always paid the bill but for the rest of the furniture we bought together; i think the tv we got on his catalogue. I don't want him to come to the house and start kicking off as it will scare my 3 girls, I have already taken his personal stuff to a friend of his to pass on.
See a solicitor - get some advice. If he's paid say £500 worth into the furniture, he may be entitled to goods worth that much. I don't know the legal position.

thank you solicitor/CAB as soon as i can get an appointment
Can you afford a new TV?

I had a slightly similar experience years ago and had to call the police when he turned up with a club hammer to try and get in the house. The police were excellent and he never did come back.

Not quite true (or relevant) in a divorce case or if a couple split up.

Just because the belongings happen to reside in one persons house does not mean they "own" them all or can keep them all.

Do go the CAB they were a great help to me, oh and keep a note of any correspondence from him too [be it texts, emails or phone-calls]. He may well be entitled to some reimbursement but any guy who wants to take a telly from his own kid can and will get more childish in his demands [IMO].
Good luck

change the locks - do it now!!! he has left the property and you do not want him back in. that is the most important thing - and tell your kids not to open the door under any circumstances. then, make him get a court order to get any stuff. until then, forget about it. but....change the ruddy locks asap!!!!!
