Social Services Help And Advice Referrals That Never Happened?

I've only knew about 3 referrals one was classed as malicious but that has been removed now there is a new referral that was never referred to them, if it did happen i would have heard from them. How can this happen? Is this a breach of data protection? Thanks

Second referral was a malicious one, ss actually sent my health visitor out I had no social services out on that referral.
third referral was October 2013 (First Domestic)
I've had three social workers since then.
The first social worker told me all three referrals and I questioned the second one as it was a malicious call. I had to sign an agreement to not allow the ex to live or be at our family home.
Second social worker came out of the blue saying she was taking over as the first social worker has switched departments, she came without paperwork and I was not told the referrals had changed. She referred me to another social worker to get me into harbour so she said.
Third social worker came out, she told me three referrals one of which I never knew about. That incident was not referred, the police took the ex to another address as they said they didn't think the cells were for him.
I've had no view of the initial assessment, or able to comment on it. I tried contacting my social worker who said she wanted to close the case but she never contacts me back.
Sure that is a breach of data protection, because first referral I was told they would intervene but they never did because there was NO referral..
any advice? I feel victimised because at the moment I am vulnerable

So your are concerned that there are three referrals on your record but one should have been removed and it hasn't been , so you are concerned that the records held for you are wrong. Is that right?
I think you have a right to see the records held.
Maybe you should seek advice from CAB.

there has only ever been 2 proper referrals, the new referral on there that has taken the over the malicious referral never existed.
Thankfully I was at solicitors in August 2012 and she can even clarify this.

as far as i can tell from your very convoluted story, there WERE 3 referrals. Even if a referral is malicious, i would hope that SS would investigate it before deciding it was malicious. The extra one you are talking about, when the police took your husband away, sounds like it should have been referred to SS anyway. There is no data protection issue whatsoever - the police are able to make a referal independently to SS if the situation warrants it and they don't even have to tell you about it. Just because you don't know about it, or weren't informed doesn't mean it never happened. Your neighbour could ring up SS if they were worried, and you wouldn't be informed. You can't say a referal never existed, because you wouldn't necessarily know it did
You are wrong, I was at solicitor last year and even if my neighbour reported me they would HAVE to investigate, and if te police DID refer it social services WOULD have intervened.. They said the first time they WOULD and I was NEVER referred and as for the malicious call they DID treat it as malicious that's why they sent my health visitor.. And this NEW referral was NOT mentioned by my first social worker he told me June August and October not mentioning this new one! Now this new one has taken the malicious calls place and they should have acted if it was a referal as they did with the malicious call!
Not really, so they failed us and they weren't domestics.. They were the ex suicide threats.. Considering my child was not present so how could it be referred? Police didn't arrest him they took him to his parents so therefore I should have had 4 referrals not three? And I knew about the malicious call before it happened the ex's mam did it
Well it's all getting pinned on me now, since the domestic they are saying there is quite a history. I never knew about the second referral the police took him to his dads saying cells aren't for him, the first time he tried hanging himself they referred it and ss said if another referral within 12months they would intervene so if this referral did happen they never acted on it and they point the finger at me considering I did everything I phoned the police not my fault they never referred it they did the first time not the second so how can they treat it as a referral when nobody came out and I'm none the weiser about is my solicitor can back me up on this
Yes, they said if I never pulled restraining orders and stuff on the ex that I was neglecting my daughter.. And 2 suicide attempts in 2months he should have been sectioned shouldn't he? They claim they try to keep families together yet they have tore mine apart and sniffing around me making me out to be the culprit when I'm the victim they have very minimal contact with my ex and threatening CPS on me when I've done nothing wrong they are abusing me worse if rather pack a punch than this :(

What were the referrals for? None of this makes any sense and you need to tell the whole story if you want help. People with mental health issues go to hospitals all the time following suicide attempts and other than being seen by psych services, some are just sent home with a referral to social services if there are children at home; they are not sectioned and nor is a restraining order needed. So I would like to know where the idea of a restraining order came from, what exactly you wanted social services to do and what the referrals were for. None of this makes any sense otherwise.
I posted my referrals if you look in the answers and there was one domestic 2013 that I needed a restraining order for or they would go to CPS.
