my 17yrs old son resides with his mum, he attends college for more than 12 hrs / week, he gets an EMA grant of 30 /week term time; he has recently started a part time job on minimum wage of around 10 hrs?week. Is his mum still entitled to child benefit for him. Whould this also affect maintanence for him which I pay monthly.

lol- here's me thinking you were concerned for your son rather than money here ;-)

It's my understanding that if your child is attending college their parents are still entitled to child benefit untill they reach 18.

Don't understand why it would effect your maintanence payments? Unless your seeking to lower the amount you pay?
As your son lives with his mother, the EMA is based on her income, or joint income if she has a partner. BOO is correct in that the parent is still entitled to Child Benefit until the child is 18 or at full time education.

Your maintenance is not taken into account. Were you hoping to pay less then?
Child benefit is paid until the 19th birthday if the child is still in higher education.
