I have to boys (9)&(11). They currently live with there mother, the mother is leaving them for long periods and also ships them off to there friends as the ex husband of hers dont get on with the boys and the boys dont like him. Her ex partner is now back and they have seen him punch walls shout and even smack the 9 year old. I am not on the birth certificates, but both have said they both want to live with me. How do i go about doing this, and does the family court take the boys try thoughts and feelings into consideration? Any advice as i need to act very quickly.

I am a bit confused.
Is the ex husband her partner or are they the same persons?
You need to contact social services and tell them what is going on and that you want them to live with you and they feel the same. if it was me i would also report this man to the police for hitting you son (and if you get him alone give him a good smack yourself)
It is also worth contacting citezens advice to see whereyou stand and what is the best thing to do about getting full custody! There are a lot of fathers for justice campaigns lately and a lot more fathers are getting custody of their children so things could go very well for you!

I'd contact a solicitor ASAP and find out what your rights are and how you can proceed from here, or even the Citizens Advice Bureau.

However please don't do as Beck's above has suggested and lamp the bloke one- it won't help your cause in the slightest!
You should report this to social services as your sons could be in danger tell them that your sons wish to live with you as they usually place the children with family if it is needed, but do not resort to violence yourself , and you should also seek the advice of a solicitor to get a parental responsibility order. If you are unemployed or on a low wage you should be able to get legal aid hope this helps and good luck
I'm just wondering why you are asking this question again as you asked it some time ago.
You said at the time you need to act very quickly.
If it is so urgent (again), take the advice given and see a solicitor who specialises in family law pronto.
