Can my neighbour demand I erect a higher fence??

I have a wire fence that is in need of repair and I am fully aware that this is my responsibility. However, my neighbour has today told me to put up a higher fence because she has no privacy. Can she make these demands of me??

Not as far as I know. If she wants a higher fence, then it's up to her to erect something on her side of the property boundary line.

no, it's not a health or safety issue.

I put up fences all around my garden for privacy. I didn't ask the 75 yr old bag next door to do it!

Unless there is a relevant covenant in force, you never need to repair any boundary fence. You can leave it in a state of disrepair, take it down altogether or (only if you so choose) replace it. Your neighbour has no right to demand that you put up a higher fence, or any fence at all. (If she wants such a fence, she can put it up herself).

Your neighbour has no right to any privacy with regard to being overlooked by your property. If you so choose, you have every right to stand in your own garden (or in your house) and to watch, photograph or video her and others in her garden.

Tell her to get knotted!

As Buenchico has said , she can not demand that you do anything with your fence.
Let her put up a fence on her side of the boundary , then you will enjoy the privacy it brings as well.Just be careful however that your old wire fence is not a danger to her .

I believe that if you own an animal, such as a dog, you have a duty to keep it safe. Unless the said dog is permanantly in a pen then you would have to provide a suitable fence.

If you cannot afford to get a new fence installed (or just don't want to) then ask her for the cost and unless it is detrimental to you or your property then she can have it as high as planning allows (2mtrs).

She could also errect a fence ON HER side of the boundry up to the permitted height. Mind you a lot of boundry disputes start with a double boundry feature.
