My mum lives in her shared ownership property; her tenancy is with the council. Down the outside of her rear garden fence is a council owned path that leads to a tenants' car park; the roots of the fir trees in my mum's garden look to have raised the paving of the path considerably. It's gotten to the point where it's really dangerous now. My mum has reported the path to the council twice, although they've not followed up.
Where does she stand in terms of liability for damage caused to the path by the trees? Are the council also liable as joint owners of the property?
I think, in the first instance, your mother should contact the council again and request an on-site meeting with them, so that everything can be explained plus the health and safety issues noted and recorded.
I'm not sure about the legal ins and outs but I would think the council would have some responsibility here.
