You could go in when he is not there or when he isn't there to stop you.. Technically you would be trespassing but that is a civil not criminal offence and nothing would ever come of it. Is it your fence or a joint fence>

The Access to Neighbouring Land Act 1992 allows you to seek a court order, granting access to a neighbour's land, where it is necessary for you to have such access in order to maintain your property or anything associated with it:

Fencing disputes are futile and should be avoided at all costs - for your own sake. If you can't speak to your neighbour about it better to let it fall down.

thanks TWR i did ask the neighbour politely but she refused and has subsequently baracaded the garden gate against getting in

Thanks Fiction Factory the fence is wholly owned by me but because of overgrown brambles and shrubbery i need access to it to remove them

yes agree - access to land act 1992
you could do it yourself to be honest ( saves money)

if she has barricaded - then you might be subject to allegations that you criminally damaged her stuff to get in

( actually I would do it when she is out - but a workman might refuse to do the evil deed without her permit)

Roizee, In a polite way can you not point out to your neighbour should the fence become broken due to non maintenence repair is she going to pay for the replacement.
