i brought my council flat in the 1980s and i have maintained the garden ever since then and even before when it was rented due to a neighboour moving in the flat that over looks my garden and complaining to the council that the hedge is too low i have since found out that i do not own the garden the council do and it is not on the deeds where do i stand with this

bear in mind the council have never cut hedges trees or mowed lawns i have always done this
Is it enclosed to make the appearance of being your garden?

Was it simply not transferred over at the time of sale and therefore a mistake?

You could try adverse possession if it is wholly enclosed.
If that's how she's started heir life there god help you, there's some miserable *** about.

the garden used to have wire fences around to seperate off which bit of the garden is mine from the others but we planted our own privit hedge and other shrubs in the garden to make it more private for us
Did you not check with the land registry or your deeds when you bought the property to see what you were buying.
I am afraid there is nothing you can do unless you try to go for squatters rights.
Hopefully a TRAINED legal eagle like Barmaid or Peter P will be along shortly to help out.

I know its a long shot but is the solicitor or the firm of solicitors that you used for the sale still in business. If so I would be asking them to review the paperwork as a first step.

No - but I think its in the wrong thread.
I think the post at 1743 is slating the neighbour who complained and then goes on to sympathise with the OP as he feels the new neighbour has started her tenancy in the flat under difficult circumstances
You at it again Balders? what I meant was, the neighbour sounds like a right pain in the rs.
Imthink the physical relationship between the flat and garden needs establishing. It sounds to me as though the flat is remote from the garden with no direct access. I.e. The garden is just a piece of land around some flats.
