Tradesman Has Left Job Half Done & Immoveable Materials Abandoned
25 Answers
Hi,
Had a tradesman start what would be a job of 2 parts. He over ordered materials by over 300%, some of which has been returned (part is unreturnable, apparently), have no idea why not all. He had said he'd take it away himself, presumably to use on another job, but inexplicably has now said he would try selling it at a fraction of what I've paid & that's what I'd get back. I queried why I would be penalised for his error [in over ordering] & he's now abandoned part 2 of the job (part 1's not completed fully, & will cost much more to now try get part 2 finished by someone else, leaving out the time that's been wasted), & I'm left with £150 worth of materials I can't use, or even move.
What do I do ?

I thought it was protocol but not, think one letter and 7 days is sufficient, guess you are keeping print outs of text messages.

Yes, Tony's right.
So, he's had legal advice, which translates as "I spoke to a mate in the pub"
Ignore that. What is sure though, however unpalatable, is that anything "legal" has to follow protocol. If you don't, you may jeopardise your case.
I know it's silly in this case, but it should be an initial 14 days. Do follow the rules, as you increase your chances of success.
Remember though, Small Claims only adjudicates. It does very little to recover claims. That's another set of rules :o(

Yes I was not going to add what happens next, but first thing to do is to get a judgement. To get over not signing for mail all you can do is to mark your envelope "hand delivered" and date it take pic and duly hand deliver it, just for overkill have someone someone take a pic of you posting it. I am sure you are but do keep a diary. Cannot help you with printing texts but I am sure someone will be able to/
