my neighbours trees are forceing his fence to lean into my garden plus brenches are over hanging my garden i have spoken to him he is going to remove his fence leaving just his trees we would put up a fence but his trees will push our fence over what can we do

For more on marking an answer as the "Best Answer", please visit our FAQ.What a neighbour of ours did when the main trunk of her trees was leaning over the fence line boundary was to have the new fence erected but to get the fencing contractors to cut out narrow "U" shapes in the panels at the relevant points is to allow the tree trunks to lean over the boundary line unrestricted. You can legally of course, remove any branches from his trees which overhang your boundary but by law you are supposed to offer them back to him. irritations like this can cause real problems between neighbours so it's best to liaise with him and try to come to an amicable agreement, especially if his overhanging branches are spoiling your enjoyment of your garden.

i am a fencing contractor , when i come across this situation i put a timber post either side of the tree and carry the supports up to 1 inch of the tree and board right up to it... thus, as the tre grows it will be able to do so but without damaging the fencing?
