I have just opened a pair so shows from eBay
They were advertised as new (ummm) and size 6

Where did that go
Anyway they are size 37 which is nowhere near a 6
I have emailed the seller - what shall I do next?

I have followed the instructions and the seller has asked me to rerun the shoes
But I paid £6 postage in the first place
What if I return them and they refuse to refund both my postages costs and they might even receive the shoes and not refund all or any of my money
Do what I do;

Check the seller's feedback and look at any negative or neutral feedback. Try and analyse whether or not they seem like a legitimate eBayer. If you think they aren't then don't send it back.

Contact the seller, tell them that they are not correct and you need a full refund. Flip it round and ask yourself this; would you send an item to someone without them paying you for it? no; so don't send it back until them refund you.

I'm no fool to eBay, it's really easy to scam people because if the money has been released to the seller there isn't much chance of getting it back unless they are honest. I hate to admit I have a friend who has done this but he has many times and all eBay do is suspend his eBay account. What does he do? MAKE ANOTHER!

Well the other feedback seems genuine (98%)
But they seem a bit strange about the return address
I initially contacted the seller direct and they asked me to send them back and sent an address - I between this I opened the case and they have now responded with "why did you open a case" and "this is my now address I just moving house"
Yes as Chris says, you have to return the item first then get the refund.
If they are 'not as described' then the seller has to refund the sale price and the postage cost. return has to be signed for delivery or the seller can just say they never got them back.

In view of your last post, it is just as well you opened a case , it looks a bit suspect. Ask eBay's help line for advice before you send them back to a diffrent address as the ebay garantee only applies if you return them to the sellers official registered ebay / paypal address.
As I said, if the item really is 'not as described' then the seller has to refund both lots of postage, but if you have just changed your mind the seller only has to refund the sales price no postage refund.
If you're going to send them back ensure you send them recorded signed for (photograph them also). I also know a person works for the fraudulent team for eBay so unfortunately I know both sides of the coin. When people 'open a case' against a seller the seller is usually very compliant - questioning your decision only throws up more concern to their legitimacy.

These were prada shoes so they were quite expensive
I am a bit cross because they weren't all that bad although not sure they were brand new
UK size 6 is a size 37 in Russia and the Ukraine.
European size 37 is as American size 6 to 6 1/2. ( UK size 4)
I think that is where the confusion has come from.

i dont think saying they are 6 when they are not is a scam - whats the point of that?

i would message them and say since the error is theirs then you should not be one penny out of pocket on this, and that you expect them to refund both sets of postage - or send you a prepaid label
