Have been offered a pitiful amount for my written-off car following an accident which was not my fault. Where do I go from here as I don't want to accept and what are my rights?

Do not agree to any offer (even verbal agreements are legally binding) and get some legal advice. It can get pretty complicated due to the difference in market value and what you think your car was worth, or paid for.
This is where an 'agreed value' policy and let your insurance comp handle it situation would have come in handy.
I agree that you shouldn't do anything which could look like acceptance of an offer. Don't forget, though, that an insurance payout is not intended to provide you with the retail price of a replacement car - it's the trade value of the one you've had written off. If your car was a bit old you'll get nothing like the price of a replacement.
My daughter had a similar problem and whilst she was prepared to sit back and accept it I said that she should reject it. She did this - based on the replacement cost of a similar cars at local garages. The company asked us to supply copies of adverts etc which we did........and she got another �400-00! But guess who did it all for her and guess how much 'commission' I got...yep...note!!
