I slipped on a wet floor in my local gym 4yrs ago,my knee was badly damaged and still giving alot of problems.I was told recently that i should of had surgery at the time of the accidentI am still aiting on a court date,i had to take a lower paid job.
what way does the court look at this,is the damaged knee blames on the fall or not getting it treated properly?

who told you you should have had an operation?
i'm confused because if an operation was the best medical course of treatment, then you would have been offered it. Are you saying you were offered it and turned it down?
Or are you saying you didn't seek any medical advice at the for the first few years after the accident.
Have you got a solicitor acting for you that can advise you?
You're too late.

You have to get the claim started within three years of the accident for personal injury claims. It is now 'statute barred'.

I dont see that you can say it is too late , from what the questioner writes .

He/she states that he/she is awaiting a court date - sounds to me that a claim has been made , prooceedings issued
( presumably before limitation ) and a court date is awaited .
