hi,
i was hit the other day whilst my car was stationary, i claimed of te insurance as the accident was not my fault at all and had damage to the car....my insurance are tellin me that i have to pay excess of 250 on completion of repairs and then they wil claim for it from the other insurer. no my argument is i was no way no how at fault the guy decided to not pay attention and hit me from behind in speed so why do i have to pay the excess should he not pay for it.
could somebody please explain this to me.
thank you

The issue of whose fault the accident was does not arise. You would be similarly liable if your car was stolen.
This is an uninsured loss and you must claim it from the Third Party who you say caused the damage. It seems from what you say that your insurer is offering to do this for you, but if they are unsuccessful you will bear the loss.

Agreeing with the last answer you must remember to read the cover details in your policy - and ask if you do not understand them fully (which few of us, if any, do.)
Better still use a reliable broker to help get the cover you need - it may cost a little more but also may save lots in the event of a claim.
Best of luck!

Just a little note here... *excess* means the amount that you are prepared to pay for before claiming on the insurance. So if the excess is 200, then the insurance company will not pay out for any claims under 200. This effectively means that you get lower premiums because you won't bother the insurance company for small claims (in this example, under 200). The only drawback is that if your car is damaged and you do claim under the insurance to get it repaired it has to go through the proper *mainstream* repairers who charge a heck of a lot more than Joe Bloggs down the road.. and sometimes you will find that the (inflated) repairs to the car will cost more than the car is actually worth, so it becomes a *write off* - the insurance company will then give you what they think the car is worth which may well be a lot less than you are expecting.
