I can't see it being illegal unless he has been discriminated against. Can his pay rate can be linked to discrimination by race, sexuality etc?

Has he had equally good annual reports as the others who are on a higher scale? Does he have a comparable skill set to those on the higher scale?
As long as there's no specific discrimination on the grounds of race, gender, age, etc (or on the grounds of full-time/part-time status) it's perfectly legal.

Unless there are agreed pay rates, negotiated by trades unions or other recognised workers' bodies, every employee's contract is entirely independent of that of any other employee's. (The only other exception would be where pay scales are laid down by law, as with teachers in state schools).

In some fields of employment (particular in the finance industry) there's no such thing as a 'norm'. A long-serving employee in the City of London might be on £30,000 p.a. When his company wants to employee someone as good as him, to work alongside him, they might have to pay the new guy £200,000 p.a. Such big differences are very common.

Eccles, not race or sexuality. He is never off sick or late for work and as for his skills he has done the job for over 20 years so if his work was not up to standard they would have told him. He shows new starters how to do the job. He always thought that he was highly thought of, he is gutted.
Is he a Union member? have you looked at the ACAS website?
