If you go here www.dti.gov.uk and search for unfair dismissal, it states that A person is not eligible to complian about unfair dismissal until they have completed a year's employment, however, This time period is reduced to 4 weeks where an employee is dismissed due to medical reasons. I doubt your employer will do so. We have 35 of a staff though and when people go off, it can really kn*cker your whole business. Remember, if you're not important enough to be missed. Then they won't miss you when you're gone.
The current law states that an employee must have 1 year's continuous employment with the same employer to qualify for unfair dismissal protection. Continuous employment carries on during sick leave, holidays and Maternity Leave.
Do you have leave entitlement that would take you over the year? There are a number of issues but your rights under a year are limited.
Get advice from Citizens Advice, but despite all the protection I doubt you will get anywhere without a long fight and then if you win there is no massive compensation. Do without the stress and move on.
The chances are that you wouldn't want to work for an idiot like that anyway as it shows how you and other employees will be treated in the future.
