I've heard that a recent change in the law entitles part-time workers the same holiday pay for bank holidays as full timers. Can anyone confirm this and expand on any details. thanks in advance
I work in a job share post, which means I work half full-time hours. My employers (a local authority) give equal rights for part-time staff, so that means I get exactly the same holiday entitlement, pro-rata, as my full-time colleagues.
Not sure where the law stands on it. I know when I first started working for them some years ago, there was no legal entitlement - just their goodwill.
My understanding is that treating part-time and full-time workers unequally with respect to holidays, training etc is in fact unlawful. Because so many part-time workers have been/are female, an attempt to treat part-time workers unequally has been interpreted as sex discrimination in disguise.
"Can a part-time worker who works Wednesday to Friday claim the right to paid bank holidays which fall on a Monday?
Only if full-time workers at the same workplace are given paid leave for bank holidays in addition to the statutory leave entitlements under the Working Time Regulations.
The Part-time Workers (Prevention of less Favourable Treatment) Regulations 2000 provide that part-time workers should not be treated less favourably than full-timers in regard to their contractual terms. As most bank and public holidays fall on a Monday, those staff who do not normally work that day could be disadvantaged. Best practice suggests that such workers should be given a pro-rata entitlement of days off in lieu according to the number of hours they work."
Corbyloo, that tallies with another aspect of my position. I do actually work Wednesday to Friday, so what usually happens is that I receive half a day's time in lieu for every bank holiday. This happens even for Good Friday, but that's not a real problem because it all evens out.
However it never seems quite as fair on my jobshare partner who almost always can only claim half a day's bank holiday, even though she has to take the whole day off.
Your bank holiday pay should always equal out. If full time workers get one day off, that is one fifth of their working week. If you do 25 hours you should get paid 5 hours for one day off i.e one fifth of your working week ! easy.
