we married six months ago and are now to seperate, we jointly bought the house however i paid the deposit is my wife entitled to half on the money made from the house and can i claim my deposit back?
Well it is up to you to decide between you what is fair. Did you only buy the house six months ago ? The fact is that both of you own all of the house and all your debts and assets are all part of the marital pot. Hopefully you will be able to sort it out without expensive solicitors but she could even get more than half the money made on the house.
You cant claim your deposit back simply because at the time it was paid this was going the home for you both to live in - that is what you expected would happen at the time. The fact that things did not work out does not mean that you can now revisit that.
If you are both young and working and without children then this really should be a 50/50 split. You will both waste more money on lawyers trying to get any more or less than that
About 7 years ago a friend was married for less than 12 months and he was able to base the divorce settlement on their financial situation on before they were married i.e. he was entitled to his 70k from the property they bought and she was entitled to the 30k she put down, the small amount of equity on the property was split 70/30. I am sure there are rulings if the marrriage is less than say 12 or 24 months.
