my friend was a witness for the applicant at a hearing, 12 months before the hearing she did a sworn affidavit giving what she thought at the time was her correct version of things. She was witness to the applicants signature on a TR1 form but did not actually watch him sign, so in her affidavit she put that she did not know whether she was witnessing the applicants or the respondent signature, once in the witness box when the judge asked her to read her affidavit and to state whether it was true, she realised that she did actually witness the applicants signature as the respondent had not signed the TR1 prior to her witnessing the applicants signature. Neither the applicants or respondents brief questionned her on this mistake whilst in the box nor did the judge make any comments. Could she be in trouble for this as it was a genuine mistake on her behalf. As I said she was acting on behalf of the applicant, but in theory I suppose her evidence could possible go against the applicant and be more favourable for the respondent. It was a genuine mistakeon her part.
