can i sue council for negligence and how do i go about it?
back in march i got offered a new council property and went and viewed it. i complained about the back fence as i have 5 children and it was falling down and being held up by a door. 2wks ago i finally moved into the property to find the fence still the same. i have been uo to the council a few times to report it as a repair, on friday i was told the HMO has been out and seen the fence and has removed it from repair as it in their opinion is satisfactory. I have taken pictures of the fence and showed a government H&S executive and they confirmed the fence is NOT satisfactory. on saturday i ended up in A&E with my teenage son as while bringing in my washing caught his foot on the door and went over on his ankle athough the injury was minor it could of been a lot worse and it could of been my 4yr old. i have picked up a claim form from the council but i am unsure whether i should get a solicitor involved to handle it or just fill in the form and leave it in the councils hands??

For all we know she couldve just got out of a abusive relationship, the father/s may have left HER and the kids, my point is you just dont know, do we? Ok so she probably saw £ signs when this happened but hey come on guys we do live in a society where were constantly told ''if theres blame, theres a claim''. She asked a question, weve told her the answer. just let it be now. Ive come on this site many a times to answer and ask questions myself and have found that more than often this site is used as a bullying forum. Ask yourself ''would you say half the things to her face that you have said on here''? probably not!
Hear what what you're saying lotsafun, and you're probably right, we wouldn't say those things out loud to someone, but we'd sure as hell still be thinking it!
I still stand by what I say though- if she's that desperate for her 4 year old to finally play out in a garden, she should do her damnest to make sure that she can. If that means making the fence secure herself, then so be it. It's the least any parent would do.

"Why should you mend the fence" ? Well maybe the welfare of your children is a good reason. If your room needs decorating will you also not do that because its not your house thats how council housing gets into such a state because tenants like you want to be provided with everything. OK maybe the fence should have been repaired but if you are that concerned do it yourself or get your teenage son to do it for you.
As I assume that we tax payers are paying for both your home and your 5 children - i say sort the fence out yourself, get a life and grow up. Do you seriously want to teach your children that they should rely on the council to sort everything out for them? I foresee 5 future benefits bums if this is how they're being shown to behave by their mum. Try leading by example. I take it the 4 year old is the youngest - so go get a job and pay for someone to fix your fence.
