Racist Council asked me to LIE on my benefit application form.
Hi, I'm Polish and have been applying for housing and tax benefit as the recession squeezed us to the limits of bearability. My African partner is a full time post graduate student studding for a masters degree and the only income is my from full time employment. The ordeal has been dragging since November and the council is successfully stalling our case ie: refusal of acceptance my claim until I bring next months pay slips or bank statements of my employer with employers financial statement for previous financial year.
It has now been about 3 months in and it does not look like I am being looked at without prejudice. My family is facing eviction and the council is sending another written requests that are eider irrelevant, illegal or in some cases nobody bothered to actually read my previous application, letters and countless of other paperwork I have provided over the months. But to ad insult to injury on the telephone those questions become irrelevant but helpful advisor always have additional set of required docs to submit and it goes on and on, back and forth. In the middle of the month I have to have my pay slip. 'cmon Britain. Are you really so ignorant or is it just the people who work at council offices?
Why I have to educate people who should be proficient in their work or at least know how to find relevant information on-line. Why did I have to read it out laud with the council worker the page of UK Border Agency so 5 seconds later it is registered in their thick scull. 'cmon England. I worked most of my life in the UK paid taxes and now I am treated like an idiot where in fact during 3 months of this ordeal I have gained greater knowledge of Housing Law that those who actually handle my case.
What to do? I want to make a claim against the council because they have jeopardised my livelihood and my home and my health,

for pointing the ignorance of this forum. Universal web translators are for idiots who think that every thing can be translated by a machine and it will make sense.
The sad thing is that it is a real matter and as far as the English Law is concerned I believe the council is contrary to the regulation that should observe in the process.
To make matters worst the council is now demanding without a court order, to realise confidential information of my employer.
My employer is a limited company regulated by Companies Act.
I am appointed Director of the company but the title is granted by default.
My company has 2 options, pay me minimum of 500/mth or declare bankruptcy. The last one would have a devastating effect on creditors who have agreed to receive owed sums supported by invoices for goods or services as and when the company is able to pay. (payments arrangements)
Based on the companies Act 2006 re: protected information and paragraph 458 of such act prevents realise of protected information. Now this also refers to Data Protection Act 1998 c.29 and needs a court order to demand disclosure.
I hope I'm right about this, however if you think that I might be wrong, please comment pointing me to appropriate legislation giving local councils the right to demand disclosure of a private limited company without a court order.

Surely as the sole shareholder you are not just a director- you also own the company.
I can understand why the council want the accounts. As you own the company I can see they'd be wary of accepting your word for it that you get paid only £500 a month for beinga director who works all hours.

Maybe you need to appoint a solicitor or arrange a meeting with the benefits people.

You are working in Full time basis. You must have received wage slips providing your Unique tax code. This is also in your p45 or p60.But if you have submitted all necessary evidence for your application to take the normal steps probably the council feel you are not entitled to any of the above benefits. Those that are entitled to housing benefits in some special circumstances are those that live on job seekers allowance which is the minimum the law says you need to live in every week. Are you or your partner receiving any benefits such as tax credits, independent adult benefit, special grant, maintenance loan or any other ? In addition, if you are the owner of the property and if you are in full time employment you are probably not ulikely to be entitled to housing benefits as you have income from employment.
Your partner is on full time education and her income should not be taken into account in mitigating this circumstances. If you feel you are entitled, visit cab or any other independent agency.
