section 39 assault
my ex partner who i have 3 children with walked out on me on xmas eve after ten years together, he had meet someone else said i had drove him away with my depression, at first it really hurt an i was texting him alot but eventually got to come to terms with it. we where geeting on fine he had children twice a week then a week before valentines day he told me he loved me an wanted to make things right but he was going to stay with this other woman while he sorted his head out as it was a free place to stay, which as you can imagine hurts an hard to understand we texted for a few weeks him saying he wanted me tellin me he loved me an not herthen his mum passed away an he told me he had moved in with his dad to take care of him an so he wouldnt be aable to have children as often, so i agreed for a few weeks but warned him if i found out he was lying i would text his girl friend an tell her but he kept saying it was me he wanted an i gave him plenty of chances to tell me he wanted her but the answer was always me. then on friday gone i found out he was not at his dads he had been at hers so i text her an told her he been texting me an he phoned me an asked if he could explain i told him no i have had enough of his lies so he started shouting on the phone an then he came to my house ran at the door once he got inside he grabbed me throw me around an shuck me up, i had a witness too my friend was with me she was trying to restrain him, i asked him to leave 3 times before i phoned the police in which he left an then came back 5 minutes later an again he was starring me out so i phoned the police who arrived very soon after in which my ex tried to drive into the police car but i am getting him done for a section 39 assult what do you think the outcome will be an will i have to attend court i know he will play on his mum dying but the mind games started before that he has also been charged with a section 5 public order act about 5 years ago ?

Your ex will probably get a Community Punishment Order if found guilty and a Bind-Over to keep the peace. Hopefully the police are also pursuing any driving offences and hopefully he 'resisted arrest'.
Yes you may have to attend court as a 'Key Witness' to give evidence. The police and / or the Witness Liaison Unit will advise accordingly.
The other girl should request that the police warn you not to contact her again under the Protection of Harassment Act then this may deter any future problems of this nature and hopefully put an end to any further aviodable nonsense.
