i have obtained around £4000 from my extended family employer, i have told them everything and am waiting to be charged, what type of sentance would be most likly for me to get,

If they have contacted the police do you mean you are waiting to be taken in under caution for an interview? You won't be charged until you have been interviewed under caution, admitted it, and then the CPS have agreed to take the case further, if the family want to press charges.
Why don't you agree to make amends and re-pay the money, ask them to forgive you, see what they say.

Sentence....not much. Probably have to pay it back, plus costs....maybe a fine and/or community service.

they want it to goto court unfortunetly, ive been interviewed going to be charged on fri they cant decide what to chrge me with...

aint much of a family to force Court. Any evidence eg CCTV etc? Say is was an agreed loan....they can deny that but can't disprove your claim.

It's not a 'locking up' offence so don't worry about that. Your punishment is likely to be something like my first post.

I dont want to worry you needlessly, but if you read into my question, about the suspect disappearing, you will find that i am in your employers situation, though if the guy had of come to me and admitted it, i would have probably asked him to pay it back before i went to the law
He had a criminal record, he stole 8k from a former employer and was sentenced to 6 months in prison, first offence, his charges for stealing from me are, obtaining money by deception, and abuse of trust, can i ask what sort of business it was that you 'obtained' your money from, because apparently that makes a difference to the sentencing

Theft is one thing, embezzlement from an employer is quite another - one which police take very seriously. I used to be in business and caught a member of staff stealing from the till. She didn't get off lightly.
1 - Your employer being family, would be saving a lot of time for, themselfs, the Police, the court's and the CPS that could be used to deal with something much more worthwhile, as you are going to be 90% likely order to repay this £4,000 back and will prevent you from finding a job 1 criminal record, and 2 if was in a job would be having quite a lot of time off for community service which would possibly end up in you being sacked. Suggest to this family member that £? amount a week is repaid and sign an agreement stating you will pay the agreed amount per week.

Not that your actions don't deserve for you to be prosecuted, but for what the courts are/will give you (a fine/community service/order to pay £ back) it's NOT worth police/courts time or the ££ which is paid by taxpayers. It's a family matter which can be dealt with within the family, and I don't expect you stole £4,000 without a reason which you have shown remorse for......Admitted everything and took responsability for your actions which is why I am not being judgemental as everybody makes mistakes and your man enough to admit and face the consequences.
If you are able to pay the money back then you will probably get Community Service such as unpaid work. If you cant then its fifty fifty whether you get prison or a Suspended prison sentence.
Will not be sent to prison, 90% confident of that, plus you've admitted taking the money so that's something like -- 1/3 reduced from sentence -- because pleaded Guilty.

The CPS have charged me with Abusing a postion of Trust as they have said i was an accounts clerk The total amount is £3542.00.
I have been offered the money to pay it back by my familly as they do not want to risk me going to jail (I have a son) but that will mean them going into debt for me, as i take it i will be ordered to pay back anyway seems little point.
checked the net for sentancing on this and it is a higher charge isnt this???
