Please help i dont know what to expect for my partner
Ok i am new to this site as to this upcoming court case. I will start from the beginning and try and keep it as brief as possible. On the 27th feb this year my partner and i went out to celebrate the birth of our baby and to watch a rugby game. My partner works away so we did not go out until approx 6.30pm. We enjoyed watching the match and then decided to go to town with 2 other friends. I used the last of my money to pay for the taxi so straight after getting out of the taxi i went to a cash point about 400 yards from the pub where our 2 friends went into. My partner followed me to the cash point. When i got to machine there was a large mad about 6ft big built thumping and swearing at the machine. I looked at my partner as if to say 'oh dear' then offered my assistance by saying ' do you want me to try my card to see if the machine that is broke or your card' He told me to f off you nosy bitch.. My partner then got into an argument with this man. They were shouting for about a minute then i tried to calm situation down. This only made things worse as again the man insulted me. My partner then left the q and went to stand the other side of the man who was still at cash machine. My partner sdaid' dont speak to my missus like that' The man replied 'what are you going to do about it' and pushed my partner aside with his elbow. This is where my life changed. My partner is of small build and 5ft 7 but they ended up fighting. I immediately stood back against the wall as i know better than to stand in the middle of a fight. The fight must have lasted about 4-5 minutes with them both ending up on the floor.
Then my partner tried to get up but the man grabbed hold of his leg with quite a force. He then said ' unlucky mate you are under arrest' My partner did not hear this but i did. Security ran over from the pub and the man let go of my partners leg.
We then walked across the road and waited for the police who were talking to the man by now!

Thanks guys for all your support it means alot. I am going to right to the complaints authority as a matter of urgency. Our solicitor did not think that it would get as far as the court room but somehow it is! its scheduled for the 23rd of this month. Also it turns out now that the original recording of my partners tape did not 'record' so the poice have recounted what was said. My partner disagrees with what was written. We will have to wait and see what happens but if he does get found guilty. I WILL DO EVERYTHING I CAN to go public with this! We should have faith in our police service not the opposite. I will keep you updated xxx

I have never heard or come across a case of a police interview on tape in a police station being found to be 'not recorded'. The defence will have a field day. We have, do we, a policeman who is the complainant who gets involved in a fight, apparently when off duty? And we have a defendant who, no doubt, was complaining about him in interview. Hey presto ! By freak chance this is the one time in living memory that the machine doesn't work! Yeeeees, I see, officer !

PS In wouldn't be worrying about section 18 (wounding or causing grievous bodily harm with intent to cause g.b.h ) It would be complete nonsense in this case because the evidence cannot possibly support such a charge or, later, a count on the indictment.. In fact I wouldn't be worrying about anything much at this stage. If it's anything like it sounds, this incident is very embarrassing for the police, whoever is the assailant and whether your partner was acting in self-defence or not. If the CPS gets wind of the nature of the embarrassment they'll either go quietly and drop the lot or offer your partner a plea of guilty to common assault. I think I'd be inclined to tell them to get lost if they do that, but be guided by the solicitor. I don't know the details !

Secondly - does anyone else think its outrageous that the poilce are allowed to investigate this themselves?? Surely this should be down to some kind of internal affairs?
If the footage clearly shows the 'office' pushing your partner first and from then on it being a one on one fight i don't see how this could possibly stand up in court.
If all else fails, talk to the newspapers!

well we went to see our barrister yesterday and i feel a little bit more hopeful (along with all your comments) i am being called as a witness and so is my partners brother who was there at the end of the fight. As the policeofficer and his wife have put in their statements that my partner ran away and hid in a local pub at the end of the fight. If they had bothered collecting the cctv this would have clearly been proved wrong. Anyway the barrister thinks that it is a joke that is has gone this far and has said that the only reason it has is due to the fact the injured party is a police officer. He is going to have a conversation with the prosecution again to see if they can resolve it before court!!! If it does make trial then he said that we have many factors going in our favour... He has advised to wait until this is resolved before complaining etc... As there are many things we have to complain about 'like my partner being locked up for 16 hours with broken fingers and not 1 break or drink..... being just one of them. Anyway thanks for your kind messages and i will keep you informed of what happens in the next 3 weeks xxx
Your solicitor is at liberty to call any witnesses, including you, he/she chooses for the rebuttal. I am inclined to agree with the last advice/comment entered to this thread. The utterance by your accuser is very apt, "Unlucky" because had he simply been a member of the public then the whole thing would have been over within minutes and never developed into the story you describe. Naturally, it is important that your solicitor stands up to any intimidation. Equally important is that you and your partner do not give in to undue pressure or in any way slant the truth. I can't speak for others, but I am curious to know in which police jurisdiction this occurred.
