On a recent night out with friend i was seriously assaulted by my ex partner in my hotel room. I have been in formed he's being charged with wounding and that it's more serious as he used a weapon during the attack and left me with some pretty bad injuries. I was wondering how long his sentence was likely to be, and would also like to know if in the event of him pleading not guilty at the court hearing would i be called to give evidence or would the CSI photo's of my injuries and the scene of the assault suffice?

If he is found guilty with gbh section 18 he will be inside minimum 1 year. If he pleads not guilty then you will have to go to court to give evidence to get him convicted.

Just a year, that seems like a very small term considering the damage he inflicted plus the fact he used a weapon, and i was hospitalised
it will depend on what he's actually been charged with

As i say i got the call from the police this morning to inform me that the crown prosecution service were charging him with wounding with intent but that's pretty much all they said along with a date for his plea hearing.
I said minimum, he could be senctenced to 2 years minimum but he will serve only 1 year and then be out again. Whatever your sentenced too you normally serve half that. If it is going to magistrate court that maximum he will serve is 6 months.

I was told it worked in ranges, an that it was a minimum starting point of 4 yrs an the judge would add or deduct time depending on the evidence. Have i been mis-informed?
Good, he will get a worse sentence. I was wrong, minimum sentence for GBH section 18 is 4 years. You need to fine out exactly what he was been charged with and use the tables in this guide;

Cheers guys.
and you may need a restraining order served on him down the line to keep him away from you for that day when he is eventually released
Hiya
Firstly im sorry to hear about this incident but a section 18 charge which is gbh wounding with intent comes in 3 catergories. The lowest being a minimum of 3-5 years if there is an absolutly clean record. Then the judge decides on sentencing to move up to middle range which is 5-7 years then max range i beleive on this charge is 7-9 years that would prob go onto the manslaughter charge then though. I hope this helps and i agree you need to get some kind of injuction. Also it makes a difference on how he pleads. IF he pleads guilty then they take a third off the sentence x

I wrote previously as my partner was up in court for section 18, i received notification from the police service who told me that it's not been dropped to section 47 ABH, (he claimed he has a drinking problem and blacked out not remebered breaking my nose or stamping on my face biting and strangling me, etc...) I just wondered what the possible outcome would be now?
Because he is saying he can't remember doing it they have probably came to a deal that if he pleads guilty they will charge him for the lesser charge of ABH. ABH with a weapon, the sentence rages from 2-4years. If he gets 2 years he could possibly get it suspended!!!!
Anyone here know if a 2 year sentence can be suspended?

I'm just back from the courts my ex was bailed again to appear again on the 22nd, no-one is telling me what is happening, i just want to know what to expect etc... I've not ever been in a situation like this and i'm a little lost. I thought it was a plea hearing but it seems that it wasn't the case. I'm rather confused. Am i going to have to attend court?
