attemted fraud
hi there im sorry to be a pain, i have been charged with 2 counts of attempted fraud as my partner was involved too. Basically we attempted to cash our own cheques in a cheque cashing store but they rang the police fair doo's in interview we held our hands up to not having sufficient funds in accounts. Thing is i was sent to prison for fraud 4 years ago but something on the scale of £45,000 this time round its sums of £1850 & £1900 but attempts. I am really worried about prison this time round as i have a young child and was so stupid to even think about doing anything like this as i have so much to loose. Please help!

sorry how do you mean im not expecting to escape punishment ive just asked for help but naturally i get your comments that i should of learned my lesson i had from first relese but clouded judgement and issues with certain things dont excuse me what so ever. I am thinking for my son and i have taken the advise of the solicitor that its been delt with in magistrates.

Ok then.....an answer......you need to go to a solicitor and ask their opinion, if not done already, and see what they advise you. Only they can help as it would be them that will be representing you in court. The circumstances you have regarding your young child will be taken into consideration hopefully.
New Judge here is a magistrate and hopefully will come on and give you his opinion of what sentence you may recieve. And good luck

Point you raise is taken, but his comment back was slightly offensive to red.....calling her 'love' and accusing her of being here to judge people.......no comment from you about that is there?....hence my comment to him...........hope that clarify's things for you.

You can't stone someone just for "not learning their lesson".
Anyone who's ever had 6 points on their licence has "not learnt their lesson" because they've been caught speeding twice. Different level, but same principle.

no i didnt i dont know what i was thinking in all fairness stupidity comes to mine crisis in life atm isnt excusable but played a big part in what i attempted to do! solicitor seems to think past wont help me just fact that i have a young child and a stable home along with been out of trouble for 4 n half yrs and made some good out of what happend last time round. been a high profile person because of my mum been killed dont make me a bad person what so ever just made me foolish in life as i made these silly mistakes which i will pay for and im sure i will make plenty more where it dont involve criminal intent if that makes sense
jayne thanks ever so much i do hope so yes i cannot believe i put myself in this bloody situation as having so much to loose but hey its my own fault but im sure once tomorrow comes i will know my fate. I'm not sure what type of help you would like us to give you? you have seen a solicitor who has been advising you, so my advice would be to stick to what she has advised you to do, as she has the benfit of all the facts plus experience in the law and this kind of situation before.
At least if it is tried and sentanced in a magistrates court, the maximum sentance that can be imposed is six months

yes telling me im foolish and hc i asked for advice not to be judged! Sandyroe cheers and im sure i will just have to see what happens tomorrow. Sara thanks again and yes i will be pleading guilty tomorrow solicitor advised me that i shouldnt get custodial but past dont help me, but again my own foolish fault he just advising me that community order or something. Thanks for the comments.
