What is the question?
The CPS decide what charges to bring and the judge should really not be making such comments (if he actually did).

sinderella, this is not the place to judge posters, in fact it is frowned upon.
1. There is no such offence as assault by beating.
2. The judge told whom?
i am not judging.just stating a fact
I'm sure there is an offence of 'assault by beating'. I know someone who was charged with it.
Daffy you are right, we shouldn't judge but it was factual. Can I suggest Mr OP you get some proper legal advice rather then try to get it here

Have you appeared in the Magistrates' Court yet?
"Assault by Beating" is a term used for Common Assault when actual physical contact of a violent nature (as opposed to no contact of a push or a shove) is involved. Being a "summary" offence it can only be dealt with in the Magistrates' court and therefore, unless the matter is heard before a District Judge (Magistrates' Courts) then no judge is involved.

As has been mentioned it is for the CPS to determine charges and the court (whether presided over by a District Judge or a bench of three "lay" magistrates) has no say in the matter. The court's function is to hear evidence (in the event of a trial) or facts from the prosecution (in the event of a guilty plea), to listen to mitigation on behalf of the defendant and to arrive at a verdict and/or sentence.`
