I was employed with a company since 1996 and left 2003 I was told to claim back dated holiday pay before the 1 July cutoff for historic overtime I have now received a letter saying my claim was in on time but since its been over many years I could only claim within 3 months since I was employed with the company is this true or do I still have a clam for historical back dated pay .
Did you notify your claim before 1st.July 2003,and this was acknowledged by the Company? This was 12 years ago which seems to be a long time for you to take action. I would think that the Company books will have long been closed concerning this matter.
I would expect the cut off to be within 3 months of the financial year end, hence 1st July. But 1st July of the year concerned.ie 1st July 2003. Or 1st July 2013 if your 2003 happens to be a typo.
Im not an expert but i think you may have lost out due to the 6 year rule under civil law. Perhaps Peter could comment. Im not sure if your claim has to be reinforced every six years to stop it expiring. Do you have the original correspondence. I think the small claims court would take a very sympathetic view if the employer simply let the claim expire.
a quick google shows that 1/july/2015 deadline was introduced so that claims can only go back 2 years. However, that only applies to claims made AFTER 1/7/15.
