On 13th April I took my iPhone 7 into my local EE shop to be sent off for repair. It was on a 2 year contract ending in September so out of its 12 months warranty. It was told to expect it back within a week.

After nearly 2 weeks and the phone had still not been received in the repair centre, EE confirmed that the courier (DPD) had lost it. I then got in touch with EE customer services and they offered to cancel the rest of the contract, give me £200 towards the upfront cost of a replacement phone and 25% discount off the line rental on a new 2 year contract. So on Saturday I went and got my new phone.

Today I get an automated text from they repair centre saying they have received my old phone! So I guess they’ll call me to see if I want to pay the repair costs. I paid £200 upfront at the start of the old contract and over 18 months of the 2year term, I just haven’t paid the balance (when it would be paid for and mine). So who owns it now?

As you have accepted EE's offer of compensation for the loss of your phone I would suggest that it belongs to them
