Probate
When is it necessary to get probate. My husband left a will but at the time of his passing he had no property in his name, and all monies except for an ISA are in joint names. The will is 12 years old and has not been updated. A property mentioned therein was disposed of some 3 years ago and no new property was purchased. Thanks for any advice.

I am sorry for your loss. I am glas there was a will ( will settle disputes later) and yes all my accts are joint !
probate is not required on small amounts

bear in mind that this is a solicitors site so they will be more than keen....
Joint accounts are outside wills, and you should be able to remove the decd by going around with a DC - we didnt bother.
I wound up an admittedly bankrupt estate 7 y ago - and I have to say that no one cared an awful lot and I am now in the process of shredding the paperwork. ( unpaid elec bills from 2015 etc)

pensions you do with a DC or - since the estate I was winding up - it was a suspicious death ( smoker, alcoholic, diabetic, I have no idea of what they thought he died from)- a TM1 -
certificate of the fact of death ( while the coroner wastes time for a year or so)
