car accident

earlier this year i was involded in a car incidence i was trying to make my way out of a small carpark to get into the traffic it meant i had to cross over the traffic coming from my right there was a large people carrier parked in front of the shops so i had to slowly move onto the road to get a clear view of the cars coming from my right when i was able to see i stopped the car and 3 cars where able to pass me none for the cars would let me out. then a motorbike came from the right i was stopped unable to move as there was a car behind me the next thing the biker droped his bike and skidded on the road in front of me although the police did not charge me with anything the biker claimed i drove out in front of him there is no damage to my car but he has made a claim to my insurer for personal injurys as well as the bike. my insurers says that although the car and bike did not touch they could find towards the biker as he was injuried. i was wondering i this is possible.

he probably assumed that as you were already so far out that you were going to come out further so he couldn't go round you, and this was the only way he could stop himself hitting you.

he has made an assumption on what you MAY do, but you didn't do it.

i understand why he chose to drop the bike rather than risk going over your car.

do you have any witnesses? or were there any cameras about?

i don't see how you can be to blame for wht someone thought you may do, though it does depend on how far out on the road you were, as to whether his assumption was justified

he dropped his bike about 30-35 ft away from the car. There were no witness and when i went to get the person in the people carrier they were gone basically it is his word against mine and as i was told my insurers will take his word cause he was hurt

I am a biker with 45 years experience but I would say you were not at fault and from my experience I would say it was completely the bikers fault!

Good luck with it, do not accept the insurances decision.

He shouldn't really have been overtaking a line of traffic at a junction. If you were stationary and have witnesses to this I'd say it is likely to be considered all his fault. See if you can get hold of the police report.
