My best friends girlfriend had been drinking all day Saturday and decided to go for a drive in here car. She got caught and tested and was found to be over 3 times the legal limit. She is up in Court today. She is going to claim diminished responsibility as she had an argument with my friend (they are both know to the police for agruing and fighting when drunk) and is claiming she was trying to get away from him. Do you think the courts will buy that? Personally I hope she rots in jail as I hate drink drivers with a passion

That is no excuse for drink driving and I agree with you. She couldve killed or injured an innocent passer by by her actions!

I'd think it would vbe ery unlikely unless there reliable independent witnesses
If she was 3 times over that'd be about 240mg of alcohol per 100ml of bllod.
The recommended course of action at that level is a 28 months ban and possible community service. A custodial sentence is recommended at 265mg, just above that.

Probably a 3 year ban and an alcohol awareness course and maybe some community service. There is no way she can plead mitigating circumstances. it also depends on whether she has any previous convictions for DD. My ex had been banned twice (once for a year and once for 3 years) when she was way over the limit (at least 3 times)and hit a parked car. She was suffering from depression at the time (had tried to commit suicide, was on anti depressants etc) and that stopped her going to prison but she got a massive fine, 3 year ban, retest, community service - the works.
