Having been divorced over 12yrs. ago. At the time, there was neg -equity, in the property. Arrears on mortgage and every thing else. Over the years everything has been sorted out. Now, the value of the house is �110,000. above the mortgage. I have been paying for everything on my own, and my X-wife has had no interest in the property since she left. The property is in joint names, on the deeds. and joint names on the mortgage. I want to transfer both the deeds and the mortgage into my sole name. As this situation happened over 12yrs. ago.Has there been any new laws passed? I'm not the only one in this boat, am I ? ? ? ? ? ? What can be done, for people lIke Me ? COME ON SORT THIS OUT SOMEONE OUT THERE ! ! ! ! ! ! !
Basically as your wife is still on the deeds she is entitled to 50% of the equity. You can go to court and argue your share, that you have paid the mortgage for 12 years but some judges will take this into account and others wont.
Where in the UK do you reside? If in Scotland it's nowhere near as grim as you think it is (and I don't mean the weather). In fact, your ex-wife is entitled to absolutely nothing if you act quickly and sharply. It will be a long answer and probably not relevant to England & Wales, so I'll keep it brief for now.
