Under Scottish law, what is the situation in terms of distribution of assets at death in a common law situation? I live with my partner but we are not married. We have a joint mortgage and separate life insurance policies which would be used to clear the mortgage if one of us died and give a little extra in our pockets until we can return to work. We have not made wills but we have no children. Could my partner's family claim anything in the absence of a will? I have been told that this could be a problem under English law but that Scottish law would offer me protection. Just need to clarify this!
