under age sex

my daughter who is 16 was in a relationship with a lad of 15..in january we found out that she is pregnant,she is keeping the baby but the relationship has failed she obviously very upset and worried that she could be arrested for under age sex...can anyone answer this........please.

She has nothing to worry about. It is illegal to have sex with a girl under 16 - but not a boy. Also as they are of similar ages the police would not become involved even if the ages were reversed
Sorry I have just realised that this changed with the Sexual Offences act 2003 - but a read of paragraph 3 of the following could help put her mind at rest

Technically she has comitted a sexual assault - but she would not be charged with it. I think that she has enough on her plate being pregnant at 16, without worrying about a charge that is very unlikely to happen.

tubeway is talking rubbish. It is illegal to have sex with someone under 16 so technically she could be prosecuted but in a case like this I think/hope the police would use a bit of what was once known as common sense.
Sorry back to answer 1 - I have checked the act and it says:

(1) A person aged 18 or over (A) commits an offence if�
(a) he intentionally causes or incites another person (B) to engage in an activity,
(b) the activity is sexual, and
(c) either�
(i) B is under 16 and A does not reasonably believe that B is 16 or over, or
(ii) B is under 13.


So as she is not over 18 - she has not comitted an offence
My brother and ex sister in law were 15 when they had their daughter nearly 10 years ago. The social services and police did not do anything as they were in a relationship. It was not just a random act or a rape

So because she's a teenager that means she's going to be a bad mother? How do you know she's not going to get a job or put herself through college or Uni after the Summer? You don't.

God help you if you ever make a mistake in your life, eh? I sincerely hope that you are not hurt by the comments of those who prefer to judge your actions rather than help you through it, and I mean that.

Hi charmed, I wish your daughter good luck. I had a baby when I was 15, he is 24 in July. I must say how proud of myself I am, was a single mother until he was 16, but I worked, bought my own house, had a car, took him on holidays. Sometimes it was a struggle, but I had good parents who helped me when neeeded, as I'm sure your daughter has. All the best to her, its hard work but very worthwhile. I have 2 young boys now , 2 & 4 years, so am doing it all again. Jane x
