pleading not guilty to pre meditated gbh
anyone any idea roughly what sort of sentence someone will get for putting someone in hospital from end january till middle of may and the injured person had brain op and it was unprovoked attack

When it comes to GBH - there are two offences;
s.18 OAP - better know as GBH, with intent
and s.20 OAP - which is the lesser offence, normally with recklessness, or if a certain defence has been sucessful.
for reading what you have put - s.18 seems more than likely to be the offence the defendant will be tried on.
If guilty, the defendent is looking at a possilbe life sentence. However, it depends of the circumstances around it, if there were any mitigating factors etc etc.
An educated guess, I would say around 12 years +
and possilbe Quantum awarded to the defendant as a result of the horrific attack.

thank you for all your answers i am still comin to terms with how a human being can do this to another human, the poor lad was sat on a wall when he was struck from behind with a weapon and it was for no reason, the t**t has changed his plea to not guilty the trial is july, my mates life is ruined now and he has half of skull missing awaiting for titanium plate, the attack happened at half one in morning, i still have memories of when he was in intensive care i hope no one else sees the pain and worry we have he was given 3 hours to live .

i'd ramp the sentence right up for that sort of thing (attack from behind), it can actually be very difficult to recover from that kind of trauma, psychologically, since you never 'know' when it might happen again, and become hyper vigilant. I can see where a life term becomes tempting....

hi the lad who got hit was sat on a wall smoking a fag with his pal who has learning difficulties there was 2 lads and they punched the first lad out cold then hit my friend from behind he is doing very very well , he is walking again, talking but suffers on the memory and also loss of use on the left. he is such a great person it annoys me that this can and does happen. he was earning 500 pounds weekly but now cant work,
grrrrrr. makes my blood boil. thankfully medical science is on his side for a recovery of sorts.

hi just to let everyone know that my auntys brother who got attacked is still suffering he cant drive lost his job no use in left side and the rat who did this to him got 14 months and did 6 mnths he is out of prison and back in our very village and poor eddie still has half his skull missing justice there is none rot in hell ashley crossland you are no man to go behind someone and do this for no reason rot in hell looser
