Mobile phone advice needed!

Hello all
Upgraded my phone end of March, and beginning of May it froze and wouldn't switch on. Sent it back to 02 who have sent me out a refurbished model of a different colour, which I don't like. They say that because I had my phone over 28 days (albeit only about 10 over) then all I am entitled to is a refurbished model. Im not happy about this and would like a brand new phone as its not my fault the phone broke.
Anyone got any good points I can raise during my next argument with o2 please??

For more on marking an answer as the "Best Answer", please visit our FAQ.hi hayley i cant give you exact advice only my experiance with mobile phone companies,i found that the work pretty much close as the can to the law without breaking it.....i brought a mobile a few years ago,it went wrong,fair enough,i sent it back 30 days later i phoned up only for them to tell me they lost it,they sent me another it went wrong again i sent it back they repaired it sent it back to mysself it went wrong again!!!!i sent it back they again lost it,so i went to the consumer advice centre and belive it or not they had done nothing wrong they could have it back 3 times before refunding me(i eventually did get my money back only after sending a recorded letter to the head office with a list of there errors)my only advice is ask them as a matter of goodwill gesture to replace the one with the one you orriginally had...if not remember them next time you upgrade and tell em to do one
