child maintenance (international?)

im wondering if anyone knows where the law stands with regards to a mother and son who live in the uk but the father lives in usa. where does the mother stand with regards to maintenance? is she stuck with whatever the father decides to send irregularly or can she get any payments legally set in stone?? thanks in advance to anyone that can help

Where a father is living abroad, the CSA can, in theory, enforce payment by i) getting a Court order and ii) getting it enforced by local law enforcement authorities. They can send orders to all EU states, USA, Canada, Australia, New Zealand and some others but they actually never do this because it costs them too much money, but as set out above, you can personally apply to the court for a maintenance order in these circumstances.

My niece and her ex husband live in the same street. If the CSA can't get money from someone who lives a few yards from his kids, I think anyone in another country doesn't stand a cat in hells chance!

i agree. i av not received a penny from the father of my son 4 15 years.the csa say hes on income support & has 2 other children.i then ask them,well how has he managd 2 buy 2 houses with cash in the last 6 years,drive a bmw,own a lorry & a van?? ther a joke!!

I have a friend who has a kid in Germany. Basically a one night stand with some German tart he met in the army.

He pays for it even though he never sees the child. Whether this is anything to do with the EU, I am unsure. But he is still forced to. Fair enough I suppose.
